أغلق قاضي المحكمة الوطنية في مدريد، سانتياغو بيدراز، ملف متابعة ابراهيم غالي زعيم جبهة البولبيساريو، الذي تم فتحه بناء على شكاية تقدمت بها الجمعية الصحراوية للدفاع عن حقوق الإنسان تتهمه فيها بارتكاب جرائم إبادة جماعية في الفترة ما بين 1975 و1990 برفقة 23 من القيادات.

وحسب بيان للمحكمة الوطنية, فإن القاضي سانتياغو بيدراز يرى أن إفادات الشهود تتعارض مع ما ورد في الشكاية التي لم ترد فيها جميع العناصر التي تسمح باعتبار هذا النوع من الجرائم إبادة جماعية.

كما أوضح أن الشكاية المقدمة سنة 2008 عن ارتكاب جرائم إبادة جماعية والاحتجاز غير القانوني والإرهاب والتعذيب بين عامي 1975 و 1990، وبالتالي فإن قانون العقوبات لسنة 1973 ينص على أن مثل هذه الجرائم تسقط بالتقادم بعد مرور 20 سنة موضحا أن هذه المدة تم تجاوزها حين وضعت الشكاية سنة 1990 وقبلها القضاء سنة 2012، ورفض القاضي اعتماد قانون العقوبات لسنة 1995 الذي ينص على عدم تقادم هذه الجرائم.

ثم يقول بدراز إنه بالنسبة لزعيم جبهة البوليساريو إبراهيم غالي فإن “هناك قصورًا واضحًا في التفاصيل ذات الصلة فيما يتعلق بظروف مكان وزمان الأحداث، وتفاصيل محددة عن مشاركة المتهم إبراهيم غالي..كل هذا يقلل من مصداقية الشهادات المقدمة ويجعل من المستحيل الحفاظ على الاتهام ضد المدعى عليه “، وبهذا يكون القاضي قد أغلق ملف متابعة زعيم البوليساريو لكنه أبقى 23 آخرين من القيادات تحت المراقبة القضائية.

وكانت وزارة الشؤون الخارجية قد أصدرت بيانا مطولا في نهاية شهر ماي الماضي ترد فيه على إسبانيا، قالت من خلاله إن ابراهيم غالي الذي دخل سرا دون إبلاغ الرباط ليس هو جوهر المشكل.

وأوضحت أن “جوهر المشكل هو مسألة ثقة تم تقويضها بين شريكين. جوهر الأزمة هو مسألة دوافع خفية لإسبانيا معادية لقضية الصحراء، القضية المقدسة لدى الشعب المغربي قاطبة، وأن لأزمة ليست مرتبطة بحالة شخص. إنها لا تبدأ بوصوله مثلما لن تنتهي بمغادرته. إنها وقبل كل شيء قصة ثقة واحترام متبادل تم الإخلال بهما بين المغرب وإسبانيا. إنها اختبار لموثوقية الشراكة بين المغرب وإسبانيا”.
